PLEASE READ CAREFULLY. By using this website, you agree to the following rules governing the NESCAFÉ® Dolce Gusto® Rewards Program. This Program is administered by Nestlé USA, 800 North Brand Boulevard, Glendale, California 91203 ("Nestlé").
A. NESCAFÉ® Dolce Gusto® Reward Program Overview:
NESCAFÉ® Dolce Gusto® Reward Program ("Reward Program") is a loyalty program sponsored by Nestlé USA through which individuals ("Participants") can collect points ("Points") by purchasing NESCAFÉ® DOLCE GUSTO® capsule boxes that will contain a code inside the packaging, available while supplies last, or through other methods as may be added from time to time.
How to Enroll:
Participant must visit Dolce-Gusto.us (the "Web Site") to register and create a Dolce Gusto account ("Account"). Participant must have a valid e-mail address. In case of dispute as to identity of the participant, the person who is the authorized e-mail account holder of the e-mail address indicated when registering (and who otherwise meets the eligibility criteria) will be deemed the Participant. Limit one (1) Account per person and per e-mail address, regardless of whether more than one person uses the same e-mail address. Open to residents of the 50 U.S., and DC.
Once a Participant has created their account, they may begin entering codes. Participant will receive points corresponding to the Code they have entered. There is no limit to the amount of codes a Participant may enter in a day. Sponsor reserves the right to change the number of Points awarded for purchases at any time during the Program, and the right to change, add, or remove the methods by which Participants can collect Points.
How to Redeem Points for Rewards:
Participants may redeem their points for reward items listed on the Web Site. Rewards will rotate through the Reward Program and are available while supplies last. Sponsor may change or remove Rewards at any time during the Reward Program.
Please allow approximately two (2) to three (3) weeks for shipment of rewards, unless otherwise noted on the Web Site. Rewards are shipped only to addresses within the 50 United States and District of Columbia. Except as otherwise provided herein, no refunds will be provided on any reward. If for any reason a reward is received damaged, becomes unavailable, or cannot be fulfilled, Sponsor, in its sole discretion, reserves the right to replace the reward with a similar item of equal or greater value.
Eligibility: Reward program is open to legal residents of the 50 U.S. and District of Columbia, 18 or older, except employees and the families of Nestlé USA, their affiliates, subsidiaries, promotion and advertising agencies. Nestlé USA, their affiliated companies, representatives, agents or employees are not responsible for, and shall be indemnified by the reward recipient against, any claims, injuries, losses or damages of any kind resulting from acceptance, use, misuse, possession, or loss of the prize. Void where prohibited by law.
Participation in the Program constitutes each Participant's full and unconditional agreement to the Reward Program details, and representation that Participant meets the eligibility requirements set out in these the Reward Program details. Those who do not comply with these Rules may be prohibited from participating in the Program.
Modification and Termination of the Program:
By participating in the Program, you hereby agree that Sponsor may modify or terminate this program at anytime and this may impact your point accumulation and redemption. A Participant's continued participation in the Program constitutes his or her acceptance of any changes to these Rules.
Participant Accounts. Sponsor will attempt to credit Participant Accounts with Points on a timely basis. However, each Participant will have the responsibility of ensuring that his/her Points are properly credited. Any claim for Points not credited accurately must be received by Sponsor within 14 days of the date of claimed accrual of such Points. Sponsor shall have no liability for any printing, production, typographical, mechanical or other errors in the Point summaries or Accounts. Sponsor reserves the right to invalidate Points from an Account if it determines that such points were improperly credited to such Account or obtained fraudulently. Sponsor reserves the right to require proof of accrual of Points and Sponsor reserves the to delay the processing or redemption of any Points without notice to Participants, in order to assure compliance with these Rules. Participants are responsible for maintaining the confidentiality of their Accounts and passwords and for restricting access to their computers, and Participants agree to accept responsibility for all activities that occur under their Accounts or passwords. Without limiting any other remedies, Sponsor may suspend or terminate a Participant's Account if Sponsor suspects that a Participant of the Reward Program details, as well as policies and procedures that Sponsor may adopt or modify from time to time. Any failure to abide by the Reward Program details or any policies or procedures implemented by Sponsor, any conduct detrimental to Sponsor, or any misrepresentation or fraudulent activities in connection with the Program may result, in addition to any rights or remedies available to Sponsor in law or equity, in the termination of participation in the Program, as well as forfeiture of Points accrued to date and any other benefits earned in connection therewith, in Sponsor's sole discretion.
No Cash Value or Transferability. Points do not constitute property, do not entitle a member to a vested right or interested and have no cash value. As such, Points are not redeemable for cash, transferable or assignable for any reason, and are not transferable upon death, as part of a domestic relations matter or otherwise by operation of law. The sale of Points is strictly prohibited. Any Points remaining in a Participant's Account at the end of the Program will be forfeited without compensation. There shall be no carry over or transfer of Points to other Sponsor Programs, or extensions of the Program beyond the Program Period, unless otherwise determined by Sponsor in its sole and absolute discretion.
General Terms and Conditions:
1. Participants agree (a) that NESCAFÉ® Dolce Gusto®, and their respective parents, subsidiaries and affiliated companies, advertising and promotion agencies, and each of their respective officers, directors, employees, representatives and agents will have no liability whatsoever for, and shall be indemnified and held harmless by participants against any liability for any injuries, losses or damages of any kind to person(s), including death, or property resulting in whole or in part, directly or indirectly, from the acceptance, possession, misuse or use of any reward; (b) and acknowledge that said parties have neither made nor are in any manner responsible for any warranty, representation or guarantee, express or implied, in law or in fact, relative to any reward component, including but not limited to, its quality, merchantability or fitness for the intended purpose, except for the written standard limited warranty which may be provided with the item from the item's manufacturer or by the service provider in conjunction with the provision of the service in question (however, the preceding excludes any warranties/representations/guarantees provided by Dolce Gusto relative to NESCAFÉ® products).;
C. Limitations of Liability
While every reasonable effort will be made to maintain and accurately reflect a participant's Account Information (including but not limited to the number of times he/she has earned points), NESCAFÉ® Dolce Gusto® assumes no responsibility for delays or technological errors that may result in inaccurate information being reflected. You are therefore encouraged to closely monitor your Account information and to maintain your own records as to the number of times you have entered the Promotion. NESCAFÉ® Dolce Gusto® is not responsible for lost, late, incomplete, stolen, misdirected, illegible or ineligible registrations, entries, unique code requests or email or for postage due mail; or for any computer, telephone, satellite, cable, network, electronic or Internet hardware or software malfunctions, failures, connections, or availability, or garbled, corrupt or jumbled transmissions, service provider/Internet/website/usenet accessibility, availability, or traffic congestion, or any technical error, or unauthorized human intervention, or the incorrect or inaccurate capture of registration, entry or other information, or the failure to capture, or loss of, any such information. NESCAFÉ® Dolce Gusto® is not responsible for any incorrect or inaccurate information, whether caused by Website users, tampering, hacking or by any of the equipment or programming associated with or utilized in the Promotion and assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, technical error, theft or destruction or unauthorized access to the Promotional Website. NESCAFÉ® Dolce Gusto® reserves the right, at their sole discretion, to disqualify any individual found, at their sole discretion, to be tampering with the operation of the Reward Program or Website, or to be acting in violation of these Reward Program details. NESCAFÉ® Dolce Gusto® is not responsible for injury or damage to participants' or to any other person's computer related to or resulting from participating in this Program or downloading materials from Website or use of Website. If, for any reason, the Promotion is not capable of running as planned by reason of, but not limited to, infection by computer virus, worms, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes which Sponsor, in its sole opinion, deems could corrupt or affect the administration, security, fairness, integrity or proper conduct of this Promotion, NESCAFÉ® Dolce Gusto® reserves the right, at its sole discretion, to cancel, terminate, modify or suspend the Promotion. Dolce Gusto is not responsible for any typographical or other error in the printing of this offer, administration of the promotion or in the announcement of the rewards.
